Terms of Service: Millovia – Bali Real Estate Agency

1. Acceptance of Terms
By accessing the Millovia website or utilizing our professional services, you agree to comply with and be bound by these Terms of Service. Millovia serves as a premier real estate platform and consultancy for properties in Bali. If you do not agree with any part of these terms, please refrain from using our services.

2. Description of Services
Millovia provides real estate brokerage, property management, and investment advisory services. We assist clients in the acquisition, sale, and rental of Bali properties, including both leasehold and freehold opportunities. While we strive for absolute accuracy, all property details provided are for informational purposes and are subject to change.

3. Legal Compliance and Land Titles
All real estate transactions facilitated by Millovia are subject to the laws of the Republic of Indonesia.

  • Leasehold (Hak Sewa): Transactions for foreign nationals are typically executed via leasehold agreements.
  • Freehold (Hak Milik): Ownership is strictly governed by Indonesian law and is reserved for eligible Indonesian citizens or specific legal entities.
  • Zoning: Clients are responsible for ensuring their intended use of a property aligns with local Bali zoning (ITR) and building permit (PBG) regulations.

4. Financial Terms

  • Deposits: A non-refundable commitment fee or deposit is required to secure any property listing for purchase or long-term lease.
  • Currency: While prices may be displayed in various currencies for convenience, the final legal transaction is generally calculated based on the Indonesian Rupiah (IDR) exchange rate at the time of signing.
  • Fees: Agency commissions and service fees are agreed upon in writing prior to the finalization of any contract.

5. Due Diligence and Liability
Millovia conducts high-level preliminary due diligence on all listings. However, we are not a law firm or a licensed notary (Notaris/PPAT). We strongly advise all clients to engage independent legal counsel to verify land titles, tax obligations, and contract validity. Millovia is not liable for structural defects, misrepresentations by property owners, or changes in government regulations.

6. Property Viewings and Site Visits
By participating in property viewings organized by Millovia, you acknowledge that you do so at your own risk. Millovia is not responsible for any personal injury or loss sustained during on-site inspections of villas, land plots, or construction sites.

7. Privacy and Data
Information provided to Millovia is used solely for the purpose of facilitating real estate transactions and internal communications. We do not sell or distribute client data to unauthorized third parties.

8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these terms shall be settled under the jurisdiction of the courts in Denpasar, Bali.
